Appeals are determined solely on the merits of the case presented, the Council can have a poor reason(s) and a weak statement but unless you have a robust appeal statement the Inspector may well side with the Council due to the weakness of the presentation of your case.

Appeals often turn on very narrow issues, sometimes these are red lines where appeals have no prospect of success, other times there is a high degree of subjectivity in assessments made or interpretation of relevant Planning Policy.

Should I Appeal?
Making a planning appeal is a serious undertaking. There are no guarantees on the outcome, and you may lose control over the timescales and face potential delays. An Inspector's decision can also impact the future potential of your site if the appeal is unsuccessful.
Despite the risks, councils sometimes make poor decisions and some planning calls are marginal. You may find yourself in a situation where pursuing a scheme to its conclusion is necessary for business or personal reasons as well.
An appeal is a useful tool to have in the toolbox but we will always advise on the best course of action to achieve a successful outcome in a timely manner and on occasion this may be to seek a resubmission of a planning application to the Council rather than appeal immediately.
