Planning Appeal Experience

I loved handling planning appeals during my 21 years in Local Government. It is a true test of your understanding of both what local and national policy requires of development. It rewards the quality of the case you present with Inspectors determining appeals based on the evidence presented to them not the number of pages your appeal statement is. Appeals are definitely quality over quantity.

I understand that I don't have a list of testimonials from private clients as a new start-up and you may be nervous engaging me, but let me assure you with over 150 appeals as a Local Government officer under my belt I can shape a case to best present your case (gamekeeper turned poacher). I can't show all the appeals I have dealt with and the nature of the issues raised in each......but to help I've set out a summary of the appeals I received decisions for in the last 6 months (well the 3 days a week I did during that time) at Wealden before I left in November 2024.

You will see 100% were dismissed, this simply means that the case I presented was sufficient to convince the Inspector the appeal should be dismissed, it does not mean I couldn't have made a case for approval.......in fact one was a member overturn I had recommended for approval originally.

An appeal for a Gyspsy and Traveller site.

In 2016 I defended an Informal Hearing on the field next to this site following a member overturn against my positive recommendation.

I had already won a previous appeal for 12 units on the same site. This resubmission failed to address those reasons and resulted in a further successfully defended appeal.

This case is a strong example of how you frame a case. The site had previously had a permission for a dwelling that lapsed. The Head of Service posted it on Linked in if you are interested.

I had recommended approval for this but it was overturned at Committee.  Defending the appeal shows how framing the case is key to success.
